These Terms and Conditions constitute an agreement made between you, whether personally or on behalf of an entity (“customer”, “you”) and Nova Bin Busters (“Nova Bin Busters”, “company”, “we”, “us”, or “our”) as an authorized user of such services provided by the company and any of its subsidiaries.
These Terms and Conditions, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Nova Bin Busters (collectively, the “Agreement”), constitutes the entire agreement between Nova Bin Busters and you regarding the bin cleaning service. By using the service, you confirm your acceptance of, and agree to be bound by, this Agreement.
These Terms and Conditions constitute an agreement concerning your access to and use of http://www.novabinbusters.ca site as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms and Conditions.
1. Service
Nova Bin Busters provides a mobile waste bin cleaning service for residential and Commercial bins.
Frequency:
Bi Weekly – Service every 2 weeks.
On Demand- One time service on agreed date
Cleaning Day is usually the day AFTER bins are emptied by the trash or recycle hauler. This is to ensure empty bins when we arrive. Variation of cleaning day depends on the areas we are servicing on specific days.
We run a route that is dynamic each day. It is impossible to set a time window for cleaning as the route changes and is updated after each stop. The route and order depends on our work load, traffic, water stops, dump stops, customer additions or deletions, amongst many other factors that make up our day. Please leave bins so they are accessible and empty the entire day. We work from sunrise to sunset.
2. Customer Responsibilities
In order for Nova Bin Busters to provide its services, the customer must abide by the following conditions, or service could be interrupted or postponed, or cancelled and fees may apply.
- A payment method must be on file prior to service. If payment was not provided in sign up, please contact us so we can take information over the phone directly with the owners of Nova Bin Busters – Bin Cleaning.
- All bin(s) must be empty and available by the curb, or in view from street and customer will hold Nova Bin Busters harmless and release Nova Bin Busters of any damages or liability to any and all surrounding property. If customer invites Nova Bin Busters onto the customer’s property or inside the garage, then customer is responsible for all damages and releases Nova Bin Busters from all liability.
- All bin(s) must be free of all trash and animal waste. Bins containing unbagged feces or trash will not be cleaned.
- All bin(s) must be free of chemicals, oils (including motor oil), any petroleum-based products, oil-based paint, glue or other adhesive, or hazardous waste of any kind. Bins containing these substances will not be cleaned.
- All bin(s) must be free of building materials, e.g. plaster, stucco or concrete. Bins containing these substances will not be cleaned.
- Nova Bin Busters will not clean damaged bins. A picture may be sent to the customer via email and/or text with a recommendation to replace.
If any of the above conditions are not met, Nova Bin Busters will not perform the service(s) and the customer is still responsible for payment. If Nova Bin Busters was not able to perform the service, a picture may be sent to the customer via email and/or text with an explanation.
Additionally, the customer understands that Nova Bin Busters will make every effort to get all debris out of the bins, but certain substances require several treatments to be completely removed. Certain substances are permanent, and some stains can not be removed. Examples include scuff marks on the exterior of the bin (from trash hauler equipment) and material build up inside of the bin.
The customer understands that flys and maggots are common in bins. We attempt to remove all existing maggots, flies, and their larvae, but do not guarantee the elimination of an infestation. Customer understands that maggots may return in bins that have been cleaned. It only takes one fly to lay eggs; and one day for these eggs to become maggots.
Customer will allow Nova Bin Busters to utilize driveway for cleaning process when necessary for safety reasons. (Busy Road or unsafe area to work on street) Nova Bin Busters will refuse to work on certain roads that present a danger to employees or assets. The customer’s driveway may be utilized in certain circumstances, and the customer releases Nova Bin Busters from any and all damages.
Customer assumes all responsibility for condition of the bin when not actively being cleaned by Nova Bin Busters or it’s associates. Customer understands that some overspray may occur during cleaning process and releases Nova Bin Busters from any responsibility of damages to property.
It is customer’s responsibility to make their empty bins available to be cleaned. If we do not receive any notice from the client in advance (via email or phone call) and we show up to the client’s house to find bins that are not available to be cleaned, the client will be subject to a the regular charge to cover our time and fuel to make the trip. This would include no bins outside, or bins full of trash/recyclables. This would not include an error by the trash/recycle hauler. If they fail to pick up on your scheduled day, then no fee applies to the client to reschedule.
3. Nova Bin Busters Responsibilities
Nova Bin Busters will schedule the customer’s service on a pre-planned route. Nova Bin Busters will attempt to service all bins on its pre-planned route. Customer will be charged as per their subscription by credit on file, or by charging the client’s stored credit card. A receipt will be sent by email to the customer.
If Nova Bin Busters is unable to provide its service(s) on the scheduled day due to inclement weather, vehicle maintenance, unforeseen events or otherwise, it will make every attempt to notify the customer in advance and reschedule the customer to the next available opportunity. Due to route scheduling conflicts and/or extended inclement weather, the service visit may be cancelled until the following scheduled service date.
Winter Weather Policy: Nova Bin Busters first priority is the safety of our customers and their property, our employees, and our equipment. At times that will include cancelling appointments due to inclement weather conditions. Nova Bin Busters will attempt to reschedule, but sometimes that may not be possible, and a cancellation of that service visit may occur. In the event of a cancellation, a subscription client may have to wait until the next scheduled cleaning visit for service. At times Nova Bin Busters may not be able to clean the exterior of the bins due to excess water overspray. The inside will still be cleaned, sanitized and deodorized, and the majority of the wastewater will be collected on the truck. Nova Bin Busters will not be held responsible for frozen water left behind from the cleaning process and the client hereby releases Nova Bin Busters from any liability.
4. Charges
The customer agrees to pay all charges for the service(s) and any applicable taxes. Nova Bin Busters reserves the right to adjust pricing at any time. Changes in pricing may be communicated to the customer via updates to the website and/or email. It is the customer’s right to choose to continue or discontinue the service at any time. For subscription plans, 30 days notice is required via email the service will continue on a recurring basis until cancelled by the customer.
Service Based Payment (1 off clean):
- Customer must have a Debit Card or Credit Card stored on file and have accepted automatic future charges.
- Customer will be billed/charged before each service visit.
- Customer is responsible for paying for the service requested regardless of the number of bins present and available for cleaning.
- An invoice is sent to customer after each service.
- Payment is automatically collected during the day of each service.
- A receipt will be sent to the customer via email after payment has occurred.
- For subscription plans service is ongoing until customer cancels service via email.
Pre-Payment (Yearly subscription)
- Customer must have a Debit Card or Credit Card stored on file, and have accepted automatic future charges.
- Pre-Payment charges will be made in advance of the first cleaning.
- Customer’s account will maintain a credit that will be drawn down after each service visit until depleted.
- Customer is responsible for paying for the service requested regardless of the number of bins present and available for cleaning.
- A receipt will be sent to the customer via email after each service to keep customer informed of current balance available on account.
- Once customer’s account is depleted, Nova Bin Busters will automatically renew the start of the following season April 1st and charge the customers for another 8-month period of service, A pricing adjustment may be necessary.
- Service is ongoing until the customer cancels service for subscription plans with 30 day notice.
Pre-Payment (Monthly subscription 8 month)
- Customer must have a Debit Card or Credit Card stored on file, and have accepted automatic future charges.
- Pre-Payment charges will be made in advance of the first cleaning, 1 month charge.
- Customer’s account will maintain a credit that will be drawn down after each service visit until depleted.
- Customer is responsible for paying for the service requested regardless of the number of bins present and available for cleaning.
- A receipt will be sent to the customer via email after each service to keep customer informed of current balance available on account.
- Once customer’s account is depleted, Nova Bin Busters will automatically charge the card each month for the current season April – November. Automatic renewal the start of the following season April 1st for another 8-month period of service, A pricing adjustment may be necessary.
- Service is ongoing until the customer cancels service for subscription plans with 30 day notice.
Nova Bin Busters will utilize industry leaders in payment processing to safely and securely store customer’s credit card information. Customer’s card will be run automatically after service, and a receipt will be sent via email.
5. Modifications to Terms and Conditions and/or Customer Agreement
Nova Bin Busters reserves the right to modify and/or amend the Terms and Conditions and/or the Customer Agreement at any time by posting a revised Terms and Conditions to www.novabinbusters.ca
6. Modifications to Service
Nova Bin Busters reserves the right to modify the service at any time for the betterment of our customers and the overall success of the service program. Customer may adjust service frequency at any time and will accept the price difference to do so.
7. Default Payments
Nova Bin Busters reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges, or if the customer’s card issuer (or its agent or affiliate) seeks return of payments previously made to Nova Bin Busters. Such rights are in addition to and not in lieu of any other legal rights or remedies available to Nova Bin Busters.
8. Cancellation of Subscription Service
The customer may cancel a subscription service at any time. If subscription cancellation occurs before four cleaning visits, the customer will be charged the minimum service fee which is the equivalent of the One Time Cleaning Rate for the number of bins cleaned. Cancellation must occur 14 days in advance of next scheduled service date. Cancellation notice is required via telephone or email. Pre-payment refunds are issued for cancellation of service for yearly subscribers only and pro rated.
9. Customer Information
We do not sell, trade, or rent customer’s personal identification information to others. Nova Bin Busters utilizes industry leading PCI compliant credit card information storage through their payment processor.
10. Sanitization and Disinfection
The customer understands that Nova Bin Busters high pressure hot water is a great defense against germs and the environments they thrive in, but that Nova Bin Busters can not guarantee the complete elimination of all contagions within, around and on bins. Nova Bin Busters will make all reasonable efforts to sanitize and disinfect to the best of their ability but makes no claims to prevent disease and/or the spread of contagions.
11. Maggots
The customer understands that flys and maggots are common in trash bins. We attempt to remove all existing maggots, flies, and their larvae, but do not guarantee the elimination of an infestation.
